Draft legal and commerce terms for digital assets, custom physical artworks, privacy, and cross-border shipping.

This is an operational draft for site display and payment integration. Final public launch should be reviewed by qualified legal counsel and localized for the target market.

1. Digital Assets Licensing

Wallpaper / Screensaver Purchase

When you purchase a digital wallpaper or screensaver from MYARTIUM, you are granted a non-exclusive, non-transferable, personal-use-only license. You may not resell, redistribute, modify, or use the image for commercial purposes, including commercial advertising, product packaging, or re-uploading to stock image platforms.

Concept Drafts / Digital Copies

Buying a digital concept draft transfers the file ownership to you for personal viewing, private collection, or non-commercial replication. The intellectual property and copyright ownership remain strictly with the original artist unless a dedicated copyright buyout agreement is explicitly signed.

2. Custom Physical Artworks

Production Timeline

Custom oil paintings and physical artworks are created on-demand by artists after order confirmation. Estimated production times vary, typically 4-8 weeks, and will be updated by email.

Deposit & Cancellation

Once the artist begins the physical creation process, the 30% deposit becomes completely non-refundable because it covers the artist's material costs and initial labor.

Shipping & Damages

Physical artworks are shipped through trackable international couriers with art-specific packaging. If an artwork arrives damaged, the buyer must provide photographic evidence within 48 hours of delivery to initiate restoration or an insurance claim process.

3. DMCA Copyright Policy

MYARTIUM respects the intellectual property of creators. If you believe that any content in our 3D virtual halls infringes your copyright, submit a formal takedown request to [email protected] with proof of original ownership. We will remove the contested artwork while evaluating the claim.

4. Privacy & Data Handling

When MYARTIUM collects user email addresses for digital delivery or physical addresses for artwork shipping, we use them only for order fulfillment, customer support, delivery, and compliance records.

No resale: MYARTIUM does not sell user email addresses or shipping information to third-party advertisers.
Transport security: Production deployments should run under HTTPS so user-submitted data is encrypted in transit.
Payment security: Credit card data should be handled by Stripe Checkout. MYARTIUM servers should not collect or store raw card numbers.

5. Cross-Border Artwork Shipping

For hand-painted physical artworks shipped from mainland China to North America, customs forms should describe the item accurately as Original Oil Painting on Canvas (Hand-painted) where applicable. Avoid vague descriptions such as Home Decor, Printed Poster, or Gift.

Recommended HS Code: 9701.10.0000, covering paintings, drawings, and pastels executed entirely by hand. A printed Certificate of Authenticity should be included with the shipment when available.
